Tenant Alleges Apartment Complex Negligence After Shooting Incident

A woman has filed a lawsuit against a property management company, alleging negligence after being shot at an apartment complex. The complaint was filed by Mercedez Fontenot in the District Court of Harris County, Texas, on September 19, 2025, against Post North Forest LLC and TAM Residential LLC.

According to the lawsuit, Mercedez Fontenot was visiting the North Forest Trails Apartments on July 31, 2025, when she was shot in the hip by an unknown assailant. This incident resulted in severe injuries requiring emergency surgery and left her with ongoing medical issues including the use of a colostomy bag. Fontenot accuses the defendants of failing to provide adequate security measures at the apartment complex despite being aware of high crime rates and previous violent incidents at the property. The plaintiff claims that reasonable steps could have been taken to prevent unauthorized access and criminal activities on the premises.

The lawsuit details several accusations against Post North Forest LLC and TAM Residential LLC, including premises liability and negligent supervision. Fontenot argues that both companies were aware of past crimes such as robberies and assaults occurring at the apartment complex but failed to implement necessary security measures like surveillance systems or hiring competent security personnel. The plaintiff also references prior litigation involving similar incidents at properties managed by these defendants, suggesting they were well aware of their duty to ensure safety but chose not to act.

Fontenot is seeking over $1 million in damages for pain and suffering, mental anguish, physical impairment, disfigurement, medical expenses, lost wages, and loss of earning capacity. Additionally, she requests exemplary damages due to gross negligence on part of the defendants for knowingly maintaining a dangerous environment without making efforts to mitigate risks.
