A Robstown man has been sentenced to 15 years in federal prison for being a felon in possession of a firearm, according to an announcement from U.S. Attorney Nicholas J. Ganjei.
Guadalupe Calderon III, 45, pleaded guilty on July 31. U.S. District Judge Davis S. Morales ordered Calderon to serve the statutory maximum of 180 months in prison, followed by three years of supervised release. During sentencing, the court reviewed video evidence showing Calderon pointing and attempting to fire a handgun at a sheriff’s deputy during a traffic stop. Judge Morales stated that he would have imposed a longer sentence if not for the statutory maximum.
The incident occurred on July 26, 2024, when law enforcement stopped Calderon’s truck. When asked for his license and insurance, Calderon pointed a Ruger pistol at the officer’s face and pulled the trigger; the gun did not discharge. Calderon then fled in his vehicle.
Authorities apprehended him about six hours later while he was riding in another car. A search found the firearm in the back seat where Calderon had been sitting, along with more than 30 rounds of ammunition and a high-capacity drum magazine.
Calderon admitted ownership of the gun and confirmed that he had pointed it at the officer earlier that day.
He is prohibited from possessing firearms due to multiple prior felony convictions under federal law.
Calderon remains in custody following his sentencing.
“The Bureau of Alcohol, Tobacco, Firearms and Explosives conducted the investigation with the assistance of the Nueces County Sheriff’s Department and Corpus Christi Police Department,” according to the press release. “Assistant U.S. Attorney Ashley Martin prosecuted the case.”
