In a significant legal battle unfolding in Harris County, Texas, two residents have filed a lawsuit against their former property management company, alleging negligence and breach of contract. The complaint was lodged by Emma Gilmore and Gabrielle Gilmore on August 22, 2025, targeting Greystar Management Services, LP and its associated entities.
The plaintiffs, Emma and Gabrielle Gilmore, claim that the defendants failed to maintain safe living conditions at their apartment located at 320 Jackson Hill Street in Houston. According to the petition filed in the District Court of Harris County, the plaintiffs experienced persistent issues with HVAC leaks and water penetration that led to severe mold growth within their residence. The Gilmores reported these issues multiple times throughout 2023 but allege that the management’s response was inadequate and delayed. “Despite repeated requests for maintenance,” the complaint states, “the defendants did nothing to protect the plaintiffs from hazardous living conditions.”
The lawsuit accuses Greystar Management Services and its affiliates of negligence for failing to remedy dangerous conditions despite being aware of them. The Gilmores argue that this negligence resulted in exposure to toxic mold levels significantly higher than acceptable standards, leading to serious health concerns. The plaintiffs also contend that the defendants violated several provisions of the Texas Deceptive Trade Practices-Consumer Protection Act by misrepresenting the safety and habitability of the apartment.
Emma and Gabrielle Gilmore are seeking monetary relief exceeding $250,000 but not more than $1 million. They request compensation for medical expenses incurred due to mold exposure, costs related to moving out of the unsafe premises, and damages for mental anguish. Additionally, they seek exemplary damages on grounds of gross negligence by the defendants.
