Plaintiffs Allege Age and Race Discrimination Against Nursing Home Operators

Charolett Tobias and Erica Fowler have filed a lawsuit against Fort Worth V Enterprises, LLC and Creative Solutions in Healthcare, Inc., alleging age and race discrimination following their terminations. The complaint was filed on November 17, 2025, in the United States District Court for the Northern District of Texas. The plaintiffs assert that they were wrongfully terminated from their positions at a nursing home facility operated by the defendants and replaced by younger Caucasian employees.

According to the complaint, both Tobias and Fowler were employed at the Estates, a nursing home facility managed by Fort Worth V Enterprises. Tobias served as a Human Resource Coordinator while Fowler worked as a Business Office Manager. Their employment began before Creative Solutions took over administrative control on February 1, 2023. The plaintiffs allege that after this transition, they faced hostility from new management which culminated in their unjust terminations—Tobias on January 17, 2024, and Fowler on December 12, 2023.

The plaintiffs argue that their dismissals were not based on legitimate performance issues but rather stemmed from discriminatory practices favoring younger Caucasian employees. They cite incidents where they were accused of policy violations without proper investigation or opportunity to defend themselves. Additionally, both women claim they had exemplary performance records prior to these allegations.

In seeking justice, Tobias and Fowler are asking the court for damages including lost wages, emotional distress compensation, attorney’s fees, and costs associated with pursuing this suit. They also request specific relief such as neutral job references and an injunction preventing further discriminatory practices by the defendants.

Represented by attorney Joslyn R. Smith of the Law Office of J.R. Smith PLLC, the plaintiffs have demanded a jury trial to resolve these allegations. The case is presided over by Judge O’Connor under Case ID: 4:25-cv-01296-O.
