Plaintiff sues grocery giant over slip-and-fall incident

Oscar Hagan’s lawsuit against a major grocery chain brings to light a concerning incident that allegedly occurred in one of its Texas stores. On November 6, 2025, Oscar Hagan filed a complaint in the District Court of Harris County, Texas, against Kroger and Kroger Texas L.P., doing business as Kroger and The Kroger Company. The complaint outlines an incident where Hagan claims to have suffered injuries due to negligence on the part of the defendants.

According to the court documents, the incident took place on December 8, 2023, at a Kroger store located at 1300 W. Fairmont Parkway in La Porte, Texas. Hagan alleges that while he was shopping at the store, he slipped and fell on a puddle of liquid substance resembling water between aisles 13 and 14. He contends that there were no warning signs indicating the wet area and asserts that this oversight by Kroger resulted in his injuries. “Defendants negligently failed to warn Plaintiff of the dangerous condition posed by the water-like puddle,” states the petition.

Hagan’s lawsuit is grounded in premises liability law, arguing that Kroger had a duty to ensure their premises were safe for customers like him. The complaint accuses Kroger of failing to maintain safe conditions by not addressing or warning about potential hazards such as wet floors. It further claims that Kroger did not adequately train or supervise employees responsible for maintaining floor safety and failed to conduct reasonable inspections which could have prevented such incidents.

The plaintiff seeks damages for various forms of suffering caused by the accident, including past and future medical expenses, physical pain and suffering, mental anguish, and physical impairment. Hagan’s legal team argues that these damages are directly linked to Kroger’s failure to uphold its duty of care towards its customers.

In addition to seeking monetary compensation within the jurisdictional limits of the court, Hagan requests pre-judgment interest from the date of injury through judgment date at maximum legal rates, post-judgment interest at legal rates, costs of court proceedings, and any other relief deemed appropriate by law or equity.
