In a case that highlights the ongoing struggle against workplace discrimination, a Black woman has filed a lawsuit alleging racial discrimination and retaliation after reporting racist language and behavior at her job. Tamica Davis filed the complaint in the United States District Court for the Northern District of Texas on December 1, 2025, against Allied Universal Security Services, Charles Schwab & Co., Inc., and Mercedes-Benz Financial Services USA LLC.
According to the complaint, Davis claims she faced race-based discrimination and retaliation after raising concerns about inappropriate racial remarks made by colleagues and supervisors. She alleges that after reporting these incidents, she was subjected to suspension without pay and denied reasonable accommodations for her disabilities. The lawsuit outlines multiple instances where Davis experienced derogatory comments, including being referred to as “girl” by her supervisor Kelton Gayoso, which she argued perpetuates a historical stereotype rooted in racism. Despite lodging formal complaints with her employer’s management, Davis contends that no effective action was taken to address or rectify the situation.
The complaint further details an incident involving a coworker named Tucker Mitchell who allegedly used racially insensitive language during a conversation with Davis. When she reported this behavior to her site manager Joseph Niezgoda, instead of addressing the issue, she was laughed at and subsequently suspended from work. The lawsuit accuses Allied Universal Security Services and Mercedes-Benz Financial Services USA LLC of failing to provide a safe working environment free from racial harassment.
Davis also asserts that her requests for reasonable accommodation due to her disabilities were unjustly denied. Suffering from conditions such as PTSD, anxiety, depression, angina, tachycardia, and lupus flares, she requested an adjustable chair at her workstation—a request she argues was simple yet crucial for her well-being—but it was dismissed by management without explanation.
In seeking justice through this legal action, Davis is asking for compensatory damages for lost wages and emotional distress resulting from the alleged discriminatory practices. She also seeks punitive damages against the defendants for their failure to prevent or address workplace discrimination and retaliation effectively.
