A former employee has taken legal action against a convenience store chain, alleging serious violations of disability rights. Artur Curyllo filed a complaint on November 25, 2025, in the United States District Court for the Northern District of Texas, Fort Worth Division, against BW Gas & Convenience Holdings, LLC, doing business as Yesway. The lawsuit accuses the company of disability discrimination, failure to accommodate his medical needs, and retaliation following his requests for reasonable adjustments at work.
Artur Curyllo is a Certified Public Accountant with over 16 years of experience. He was hired by Yesway on April 15, 2024, as a Senior Technical Accountant. Curyllo claims that he suffers from several disabilities including permanent nerve damage and severe anxiety disorders which significantly impact his daily life activities. Despite these challenges, he performed his duties diligently and received positive feedback from his superiors until he disclosed his disabilities and requested accommodations. “Plaintiff performed his duties competently and in good faith,” the complaint states, noting that he often worked late into the night to meet deadlines.
Curyllo’s request for accommodations included time off for medical appointments and permission to use his phone at work to manage anxiety. Initially approved by his manager Jia Kwong, these accommodations were later disregarded or inadequately addressed by Yesway’s management. After disclosing additional disabilities in July 2024 and requesting further accommodations such as brief stretches during work hours and flexible scheduling for medical reasons, Curyllo alleges that Yesway provided him with invasive ADA paperwork demanding unnecessary details about his medications.
The situation escalated when Curyllo faced disciplinary actions without prior notice or proper procedural steps being followed. He received a written warning on August 1, 2024, which denied compensation for certain days despite prior approvals for time off due to emergencies. The plaintiff contends that these actions were retaliatory measures taken after he disclosed his disabilities and sought necessary accommodations.
In response to what he perceived as unfair treatment and discrimination, Curyllo filed complaints internally with various members of Yesway’s management team but received no investigation or resolution. On August 22, 2024, without prior notice or justification based on performance issues—claims which Curyllo disputes with documented evidence—his employment was terminated abruptly.
Curyllo is seeking judgment from the court declaring that Yesway violated both federal (ADA) and state (Texas Labor Code) laws regarding disability discrimination and accommodation failures. He requests back pay, compensatory damages for emotional distress caused by these events, punitive damages to deter future violations by the defendant company against other employees with disabilities like himself who might face similar situations if unchecked; along with attorney fees should counsel be retained later during proceedings.
