English argues that this arrest was part of a coordinated effort to dispossess him of his property and silence him. According to the complaint, English had been involved in ongoing criminal proceedings in Montgomery County since June 2023 for charges of “Failure to Identify” and “Resisting Arrest.” He contends that these charges were improperly pursued despite being removed to federal court earlier in January 2024.
English alleges that on November 13, Deputy J. Reed and other officers executed an arrest warrant at his residence precisely during a contested property seizure event. This timing suggests an intention to neutralize his legal challenges by removing him physically from the scene. English maintains that the warrant used for his arrest was void due to previous federal removal proceedings and procedural violations by Montgomery County officials.
In detailing the events leading up to his arrest, English describes how officers ignored valid identification documents he presented, such as his World Passport and DBA/common law name change documentation. He further accuses the defendants of refusing to acknowledge the void status of the warrant or recognize his rights under federal law.
The complaint outlines multiple causes of action against the defendants: false arrest and unlawful seizure; violation of federal removal statutes; retaliatory conspiracy; and due process violations under constitutional amendments IV and XIV. English seeks compensatory damages exceeding $1 million for loss of liberty, emotional distress, legal expenses, and reputational harm. Additionally, he requests punitive damages against individual defendants as determined by a jury.
English also seeks injunctive relief to prevent further state prosecution using the void warrant and demands expungement of records along with restoration of reputation and property rights. A declaratory judgment is sought to affirm these actions as unconstitutional.
