Plaintiff Alleges Negligence Against Construction Companies Following Explosion

In a dramatic turn of events, a Texas resident has filed a lawsuit following a catastrophic explosion at a hotel construction site that left him severely injured. Michael Marquez lodged the complaint against Neway Hospitality, L.P., and E.E. Reed Construction, L.P., in the District Court of Harris County, Texas, on October 10, 2025. The defendants are accused of negligence and gross negligence leading to the incident.

According to the details outlined in the petition, Marquez was delivering furniture to a hotel under construction at 1319 Texas Street in Houston when an unexpected explosion occurred on October 1, 2025. The blast resulted in severe bodily injuries requiring extensive medical treatment for Marquez. The plaintiff alleges that Neway Hospitality owned the property and was developing it alongside general contractor E.E. Reed Construction. The lawsuit claims that both companies failed to safely construct the building and neglected necessary precautions to prevent such an explosion.

The plaintiff’s accusations are grave: “Defendants failed to properly install, construct, and inspect crucial elements in the building,” leading to unsafe conditions. Specific allegations include inadequate training for employees and contractors, insufficient equipment provision, failure to inspect and maintain equipment properly, and neglecting safety measures like barricading or isolating explosion hazards.

Marquez’s legal team argues that these failures amount to negligence and gross negligence under Texas law. They assert that the defendants’ actions were not only careless but also exhibited “flagrant and malicious disregard” for safety standards. As such, Marquez is seeking punitive damages due to what he describes as the defendants’ conscious disregard for known risks.

Beyond punitive damages, Marquez seeks compensation for medical expenses incurred from his injuries—both past and future—as well as physical pain and suffering endured as a result of the incident. He also claims loss of earnings capacity due to his injuries’ impact on his ability to work.

The case emphasizes premises liability claims against both defendants as well. It argues that they owned or controlled the area where Marquez was injured yet failed to mitigate hazards or ensure safe installation of equipment—actions which posed unreasonable risks they should have been aware of.

Represented by attorneys Ryan H. Zehl, Justin C. Warner, and Misha J. Paltiyevich from Zehl & Associates P.C., Marquez demands a jury trial seeking over $1 million in damages—a figure he believes reflects fair compensation given his ordeal’s severity.

This case is being presided over by Judge Marilyn Burgess under Case ID No. 106714721 at Harris County’s 269th District Court.
