Plaintiff Alleges Major Food Company Responsible for Contaminated Product Leading to Severe Health Issues

Keiala Lapoint has taken legal action against a major food company, alleging severe health repercussions due to contaminated food. On November 24, 2025, Keiala Lapoint filed a complaint in the United States District Court for the Southern District of Texas against Kraft Heinz Foods Company, LLC. The lawsuit stems from allegations that Lapoint suffered serious illness and premature labor after consuming Oscar Mayer Turkey Bacon tainted with Listeria monocytogenes.

The complaint details that on October 29, 2025, Lapoint filed her Original Petition in Harris County’s District Court. She claims that after eating the contaminated product, she experienced severe symptoms leading to hospitalization and premature labor. Her child, referred to as Minor Plaintiff K.I., was born at just twenty-six weeks gestation and has been hospitalized in the Neonatal Intensive Care Unit (NICU) since birth. The plaintiffs argue that these events resulted in “severe and permanent” injuries.

Lapoint accuses Kraft Heinz of negligence, citing multiple causes of action including strict liability manufacturing defect and failure to warn consumers about potential dangers. The plaintiffs are seeking compensatory damages for medical expenses, physical pain, mental anguish, and other related costs. They also seek punitive damages due to what they describe as gross negligence on the part of Kraft Heinz.

Kraft Heinz has moved to have the case heard in federal court under diversity jurisdiction rules because it involves parties from different states and an amount exceeding $75,000 is at stake. The company disputes the claims but acknowledges that given the severity of the alleged injuries and damages claimed by Lapoint and her child, the case meets federal jurisdiction requirements.

The plaintiffs are represented by Sutton P. Davis from Daspit Law Firm PLLC while Camille Kraft from Wilson Elser Moskowitz Edelman & Dicker LLP represents Kraft Heinz Foods Company LLC. The case is presided over by judges within the Southern District of Texas under Case ID 4:25-cv-05648.
