A Houston resident has taken legal action against a local shopping center, alleging violations of the Americans with Disabilities Act (ADA). Erik Garcia filed a complaint on November 18, 2025, in the United States District Court for the Southern District of Texas against Wilcrest Village West Center, L.P. The lawsuit claims that the property fails to meet ADA standards, thereby denying him and others with disabilities full access to its facilities.
Erik Garcia, who relies on a wheelchair for mobility, visited Ocean Crawfish, a restaurant located within the Wilcrest Village West Center at 8200 Wilcrest, Houston. During his visit on September 10, 2025, he encountered numerous barriers that limited his access to the establishment. According to Garcia’s complaint, these barriers include improperly designed parking spaces and ramps that do not comply with ADA Accessibility Guidelines (ADAAG). “The access aisle to the two accessible parking spaces is not level due to the presence of an accessible ramp,” reads one part of the complaint. Furthermore, Garcia asserts that these conditions make it dangerous and difficult for him to safely enter and exit his vehicle.
Garcia’s lawsuit details several specific violations at different points around the property. These include inadequate signage for accessible parking spaces and ramps with excessive slopes or vertical rises. Inside Ocean Crawfish itself, he noted issues such as restrooms lacking proper grab bars and sinks without adequate knee clearance due to obstructive elements like trash receptacles. “The interior of the restroom stall has a clear turning space of less than 60 inches in diameter,” states another section of his filing.
The plaintiff argues that these conditions constitute discrimination under Title III of the ADA by denying individuals with disabilities equal enjoyment of goods and services offered at public accommodations. Garcia is seeking injunctive relief from the court to compel Wilcrest Village West Center to remove these physical barriers and bring their property into compliance with federal law. Additionally, he requests compensation for attorney’s fees and litigation costs incurred during this process.
