A Houston resident is taking a stand against disability discrimination, alleging that several local businesses have failed to comply with the Americans with Disabilities Act (ADA). Erik Garcia filed a complaint in the United States District Court for the Southern District of Texas on February 3, 2026, targeting PVS Ventures LLC, TAC Fondren LLC, and LV Parkview Investments LLC for their alleged failure to remove physical barriers at their properties.
Erik Garcia, who relies on a wheelchair for mobility, has accused these companies of violating Title III of the ADA by not ensuring accessible facilities at properties they own. The lawsuit details multiple instances where Garcia faced significant obstacles due to inadequate accessibility features. According to the complaint, these barriers include improperly sloped parking spaces and ramps, insufficient signage for accessible parking spots, and dangerous vertical rises on ramps that could potentially cause wheelchairs to tip over. Garcia claims these violations have deterred him from visiting businesses like Ruchi’s Taqueria and Wingbay located on the defendants’ properties.
Garcia’s complaint highlights his dual role as both a customer and an advocate for disabled individuals. He argues that despite being aware of the accessibility issues during his visits in December 2025 and prior attempts to patronize these establishments, he was forced to refrain from entering due to safety concerns. The plaintiff contends that these barriers not only prevent him from enjoying public accommodations but also represent a broader societal issue where individuals with disabilities are unfairly marginalized.
The legal action seeks more than just personal relief; it aims to compel the defendants to address and rectify all ADA violations across their properties. Garcia is asking the court for a permanent injunction against PVS Ventures LLC, TAC Fondren LLC, and LV Parkview Investments LLC to stop discriminatory practices immediately. Furthermore, he demands modifications be made so that all facilities are fully accessible according to ADA standards. The lawsuit also requests compensation for attorney fees and litigation costs incurred during this process.
