Plaintiff alleges insurance company engaged in unlawful telemarketing practices

A legal battle is brewing over allegations of aggressive and unlawful telemarketing practices. Micheal Price, a resident of DeSoto, Texas, has filed a complaint against Transamerica Life Insurance Company and several associated parties in the United States District Court for the Northern District of Texas on November 24, 2025. The lawsuit accuses Transamerica and its affiliates of violating federal and state laws through a relentless telemarketing campaign that targeted Price’s personal cell phone.

According to the complaint, Price claims he was bombarded with at least 38 unsolicited calls between September and November 2025. These calls allegedly used automated voices, spoofed caller IDs, and deceptive scripts to mislead him into purchasing a life insurance policy from Transamerica. Price’s phone number has been listed on the National Do Not Call Registry since 2018, making these calls illegal under the Telephone Consumer Protection Act (TCPA) and other related laws. “These calls used the same telemarketing structure… including automated dialing systems indicators,” Price states in his filing.

The defendants named in the lawsuit include Omar Trejo, an insurance agent who allegedly facilitated the sale of the policy; Family Comes First Insurance, LLC (FCFI), Trejo’s agency; and unknown entities labeled as John Does 1-10 responsible for placing the illegal calls. Price asserts that these parties financially benefited from this scheme as evidenced by a direct debit transaction from his bank account by Transamerica following the deceptive sale.

Price is seeking statutory damages for each violation under both federal and Texas law, which could amount to over $1 million given the volume of calls involved. He also demands treble damages for willful violations, civil penalties for spoofing activities, attorney fees, costs of suit, and any other relief deemed appropriate by the court.
