In a compelling legal battle, a former employee is taking a stand against his previous employer, alleging wrongful termination due to disability discrimination. On February 17, 2026, Darrell Dean filed a complaint in the United States District Court for the Northern District of Texas against Guardian Industries, LLC. The case highlights serious allegations of discrimination under the Americans with Disabilities Act (ADA), bringing attention to issues of workplace fairness and rights for individuals with disabilities.
Darrell Dean’s journey with Guardian Industries began in June 2018 when he was employed as a Floor Hand in Corsicana, Texas. His career took an unfortunate turn on December 27, 2023, when he sustained an umbilical hernia while performing his duties. Following surgery and recovery, Dean attempted to return to work but faced further health challenges. On March 18, 2024, he experienced heart palpitations and sought medical attention. Despite his efforts to obtain medical clearance to resume work, Dean encountered obstacles that ultimately led to his termination on June 6, 2024. According to the complaint, Guardian Industries perceived or regarded Dean as disabled and discriminated against him by terminating his employment under the pretext of “job abandonment.”
Dean’s lawsuit claims that Guardian Industries violated the ADA by subjecting him to different terms and conditions of employment due to his disabilities and medical leave. He argues that the company’s actions were not only discriminatory but also malicious or recklessly indifferent to his federally protected rights. As a result of these alleged violations, Dean seeks back pay, front pay, compensatory damages for emotional distress and mental anguish, punitive damages intended to deter similar conduct in the future, attorneys’ fees, expert witness fees, and court costs.
Represented by attorney Daryl J. Sinkule from Kilgore & Kilgore PLLC in Dallas, Texas, Darrell Dean is determined to seek justice through this legal action. The case has been assigned Civil Action No. 3:26-cv-513 and will be presided over by Judge L.
