The case traces back to an incident on February 7, 2024, when Cartwright claims that Ross unlawfully entered his home in Van Zandt County without a warrant. According to the complaint, Ross attempted to evict Cartwright from a relative’s property while acting under the color of state law. This alleged action violated Cartwright’s Fourth Amendment rights and demonstrated an abuse of authority unique to Ross’s position as a peace officer. “I don’t need a warrant; I am a constable,” Ross reportedly told Cartwright during the encounter.
Ross was later indicted by a Van Zandt Grand Jury on charges of Criminal Trespass and Official Oppression. As part of his plea deal, he surrendered his Texas Peace Officer license. The complaint also accuses Kaufman County Precinct 2 Constable Office of having procedures that show indifference to constitutional rights, allowing officers like Ross to conduct warrantless searches and seize property unlawfully.
Cartwright is seeking $125,000 in damages from Ross for trespass and violation of constitutional rights and $250,000 from Kaufman County for its practices that allegedly facilitated these violations. Additionally, he seeks exemplary damages due to what he describes as egregious conduct by Ross. The lawsuit also demands reasonable attorney’s fees and costs incurred in pursuing this action.
