Plaintiff alleges former employer gas station operators violated wage laws

A former employee has filed a lawsuit against his previous employers, accusing them of failing to pay him for overtime and straight-time wages. The complaint was filed by Mir Ajmal Ali in the United States District Court for the Southern District of Texas on February 15, 2026, against Almani Zaib & Sons Corporation and its owners, Ashfaque Ali Almani and Ishtiaque Ali Almani.

Mir Ajmal Ali worked as a store clerk at a Shell Gas Station operated by the defendants from June 1, 2025, until September 30, 2025. He claims that during his employment, he was not compensated for overtime hours worked beyond the standard 40-hour workweek as required under the Fair Labor Standards Act (FLSA). The complaint alleges that Mr. Ali regularly worked between 70 and 85 hours per week but was paid only in cash at an hourly rate of $13.00 without receiving any overtime pay. Furthermore, it is claimed that he did not receive payment for his last paycheck or for several off-the-clock hours he worked.

The lawsuit asserts that the defendants’ actions were willful violations of both federal and Texas state laws. Mr. Ali argues that they failed to maintain proper records of his work hours and payments due to their practice of paying him in cash. The complaint also highlights that the defendants were aware of their legal obligations under the FLSA but chose to ignore them deliberately.

Mr. Ali is seeking several forms of relief from the court. He requests unpaid wages for both straight-time and overtime work, liquidated damages equal to those unpaid wages, attorney’s fees, costs, and post-judgment interest. Additionally, he accuses the defendants of breaching their contractual agreement by not paying him as promised and seeks compensation for unjust enrichment resulting from their acceptance of his services without proper payment.

The case is being handled by Salar Ali Ahmed from ALI S. AHMED, P.C., representing Mr. Ali as his attorney. The case has been assigned Case ID No. 4:26-cv-01228 in front of a jury trial demand.
