A former employee is taking legal action against a healthcare services provider, alleging disability discrimination and retaliation. Tasha Hough filed a complaint in the United States District Court for the Southern District of Texas on February 27, 2026, against AccentCare, Inc., claiming violations of the Americans with Disabilities Act (ADA).
The lawsuit details Hough’s struggles with her employer after she was rehired in 2024 despite a known disabling back injury sustained during her initial employment with AccentCare. The complaint highlights that Hough’s role involved phone and computer-based work, which initially seemed manageable given her condition. However, after relocating its office twice, AccentCare significantly increased Hough’s commute time from fifteen minutes to over an hour and forty-five minutes each way. This prolonged commute exacerbated her back pain and led to new symptoms.
Over six months, Hough submitted four written requests for remote work accommodations supported by medical certifications from three different providers, including a neurosurgeon. These requests were either denied or limited without adequate explanation. In one instance, approval was granted for only five weeks instead of the recommended three to six months. Hough alleges that AccentCare did not engage in the interactive process required by law and failed to accommodate her disability reasonably.
Hough further claims that when she persisted in seeking accommodations under the ADA, AccentCare retaliated by terminating her employment on September 10, 2025. The company cited productivity issues as the reason for termination; however, Hough argues this was a pretext for discrimination and retaliation since other employees with similar productivity levels were not terminated.
In addition to seeking back pay and lost benefits, Hough is asking for compensatory damages for emotional distress and mental anguish as well as punitive damages. She also seeks attorneys’ fees and costs along with any other relief deemed appropriate by the court.
