Patric Farmer has filed a class and collective action lawsuit against U.S. Silica Company in the United States District Court for the Southern District of Texas, Houston Division. The case, numbered 4:25-cv-5393, alleges that U.S. Silica violated the Fair Labor Standards Act (FLSA) and the South Carolina Payment of Wages Act (SCPWA) by failing to pay its hourly employees for all hours worked, including overtime. Farmer claims that U.S. Silica’s “off the clock” policy requires employees to don safety gear without compensation and excludes non-discretionary bonuses from their regular rates of pay for overtime purposes. The lawsuit seeks unpaid wages, liquidated damages, and attorney fees.
