Kroger accused of negligence after customer slip-and-fall incident

In a dramatic turn of events, a Harris County resident has taken legal action against a major retail chain following an incident that left him with severe injuries. Derrick Don Lewis filed a complaint on October 17, 2025, in the District Court of Harris County, Texas, accusing The Kroger Co. of negligence after he suffered injuries from a slip and fall at one of their stores.

The lawsuit, filed by Derrick Don Lewis, details an incident that occurred on August 3, 2024, at the Kroger Store located at 9125 W Sam Houston Parkway in Houston. According to the complaint, Lewis was shopping when he slipped on spaghetti sauce that had been left on the floor. The fall resulted in significant injuries for which Lewis sought medical treatment. The plaintiff argues that these injuries were directly caused by Kroger’s failure to maintain safe premises for its customers.

Lewis contends that as an invitee on the premises, Kroger owed him a duty of care to ensure his safety while shopping. He claims that the company breached this duty by failing to adequately warn him of the hazardous condition and not taking necessary steps to rectify it. The petition highlights several alleged failures by Kroger including not warning about concealed dangers, not maintaining safe conditions, and lacking proper employee training regarding store maintenance.

The legal document further accuses Kroger of negligent undertaking under Restatement (Second) of Torts §323. It states that Kroger undertook services necessary for customer protection but failed to exercise reasonable care in performing these duties—particularly in maintaining and inspecting the premises regularly. As a result of these alleged oversights, Lewis suffered physical harm.

Lewis is seeking monetary relief ranging between $250,000 and $1 million for damages incurred due to past and future medical expenses, physical pain and mental anguish, physical impairment, loss of enjoyment of life among other claims. He also requests pre-judgment interest and post-judgment interest along with any other relief deemed appropriate by the court.

Representing Derrick Don Lewis are attorneys Steven R. Hollingsworth and John Major Spalding from Hollingsworth Law Firm PLLC based in Houston. The case has been assigned Case ID 2025-79350 and will be heard in the 61st Judicial District Court under Judge Jarod Stirrup.
