Kirk Mackey has filed a lawsuit against Fairbanks Center, Ltd. in the United States District Court for the Southern District of Texas, Houston Division. The complaint alleges violations of the Americans with Disabilities Act (ADA) due to physical barriers at a property located at 7418 Fairbanks North Houston Road, which includes Captain’s Seafood Kitchen. Mackey, who uses a wheelchair, claims that these barriers prevent him from accessing the property safely and equally. The lawsuit seeks injunctive relief requiring Fairbanks Center to remove these barriers and comply with ADA standards.

Mackey’s attorney, Douglas S. Schapiro, argues that the removal of these barriers is readily achievable and necessary for compliance with federal law. The complaint details numerous accessibility issues such as inadequate parking spaces, non-compliant door thresholds, and restroom facilities that fail to meet ADA guidelines. Mackey requests that the court order Fairbanks Center to make necessary modifications and award him attorney’s fees and litigation costs.
