The plaintiffs, Damon and Monique Hardy, are challenging the actions of ON Q Financial and Mr. Cooper regarding their single-family residential mortgage located at 18315 Saxon Creek Dr., Humble, Texas. The complaint accuses the defendants of fraud by intentional misrepresentation and failure to properly record assignments related to their mortgage. According to the Hardys, ON Q Financial and Mr. Cooper’s misconduct began with the origination and servicing of their mortgage loan. They argue that these companies concealed critical information about the securitization process involving their mortgage payments.
The Hardys’ lawsuit presents detailed allegations of fraud, asserting that ON Q Financial and Mr. Cooper intentionally misrepresented facts to deceive them for financial gain. The plaintiffs allege that their payment stream was improperly handled through a complex securitization process involving Freddie Mac Multiclass Certificates, Series 4933 Trust without proper documentation or notification to them as borrowers. “Plaintiff alleges that the note does not evidence any loan,” states one part of the complaint, highlighting a central argument in their case.
In seeking relief from the court, Damon and Monique Hardy are asking for damages due to what they describe as an invasion of a legally protected interest that is both concrete and particularized. They assert that this harm is neither hypothetical nor conjectural but rather an actual injury resulting from the defendants’ actions.
