Grayson County man indicted for unlawful machine gun possession

A Grayson County resident has been indicted on federal charges for possessing a machine gun, according to an announcement from Acting U.S. Attorney Jay R. Combs for the Eastern District of Texas.

Xavier Donnell Porter, 32, was named in an indictment returned by a federal grand jury this week in the Eastern District of Texas. He is charged with possession of a firearm by a convicted felon, possession of ammunition, and possession of a machine gun.

The indictment alleges that on December 5, 2024, Porter was found in possession of a machine gun. Authorities say further investigation revealed he is a convicted felon and prohibited by federal law from owning or possessing firearms or ammunition.

“This case is part of Operation Take Back America, a nationwide initiative that marshals the full resources of the Department of Justice to repel the invasion of illegal immigration, achieve the total elimination of cartels and transnational criminal organizations (TCOs) and protect our communities from the perpetrators of violent crime. Operation Take Back America streamlines efforts and resources from the Department’s Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood (PSN).”

If convicted, Porter faces up to 15 years in federal prison.

The Bureau of Alcohol, Tobacco, Firearms and Explosives is investigating the case. Assistant U.S. Attorney Chalana Oliver is prosecuting.

“A federal indictment is not evidence of guilt. All defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.”
