A former employee has filed a lawsuit against his previous employer, alleging serious misconduct and discrimination. Simpson Borens lodged the complaint on December 5, 2025, in the United States District Court for the Northern District of Texas, Dallas Division, targeting Puttshack USA, Inc., Puttshack Dallas VOP, LLC, and Puttshack Payroll Services, Inc. as defendants.

The case centers around an incident that occurred on June 24, 2024, during a company-sponsored event where Borens claims he was sexually assaulted by a manager named Andrea Ciaburri. According to the complaint, Ciaburri forcibly pulled down Borens’ swimming trunks in front of coworkers at a pool party. This act allegedly led to severe humiliation and emotional distress for Borens. Despite reporting the incident to Regional Manager Josh Saint-Pierre in July 2024, no action was taken; instead, Saint-Pierre reportedly laughed off the complaint.

Borens alleges that after reporting the assault, he faced retaliation from Ciaburri who falsely accused him of drinking with patrons—a practice he claims was common among company employees during events. Following this accusation, Borens was placed on paid leave and subsequently terminated on September 15, 2024. Meanwhile, Ciaburri was promoted to Borens’ former position as Director of Operations.

The plaintiff accuses the defendants of creating a hostile work environment and engaging in sex discrimination under Title VII of the Civil Rights Act of 1964 and Texas state law. He also claims intentional infliction of emotional distress and negligent hiring practices by Puttshack for failing to address his complaints or properly train their managers on sexual harassment policies.

In terms of relief sought from the court, Borens is requesting back pay and front pay along with compensatory damages for emotional distress and loss of reputation. He is also seeking punitive damages due to what he describes as malicious conduct by the defendants. Additionally, he demands attorney’s fees and costs under federal and state law provisions alongside injunctive relief such as reinstatement or policy reforms within Puttshack.

The legal representation for Simpson Borens is provided by Gustavo L. Mignucci from The Mignucci Firm PLLC based in Dallas. The case is identified under Case ID: 3:25-cv-03358-D with proceedings overseen by Judge D (full name not specified).
