In a lawsuit filed in the United States District Court for the Northern District of Texas, D’Andre McClarty, an African American employee, accuses Kleen Pipe and its President/CEO Michael Janczak of racial discrimination, creating a hostile work environment, and retaliatory termination. The complaint alleges that McClarty faced repeated racial harassment from a co-worker named Kevin, who used racial slurs openly in the workplace. Despite reporting this behavior to his supervisor Chad, no corrective action was taken; instead, management allegedly condoned the use of such language. Shortly after raising these concerns, McClarty was terminated under what he claims were pretextual reasons. The suit seeks monetary damages for lost wages and emotional distress as well as punitive damages due to alleged violations of 42 U.S.C. § 1981.
