This duty includes inspecting for hazards and providing warnings or remedies for dangerous conditions.

Avelar alleges that Academy Sports and Outdoors had actual knowledge of the hazard since it was caused or allowed by its employees. She further claims that even if they were unaware initially, they should have discovered it through reasonable inspection procedures. The complaint outlines several failures on part of the defendant: maintaining safe pathways within the store; inspecting areas where dangers existed; correcting hazardous conditions; warning customers about known dangers; providing a safe environment; adequately training staff; supervising employees properly; ensuring safety protocols are followed.

As a result of these alleged failures, Maria Avelar is seeking damages ranging from $1 million to $10 million for medical expenses incurred due to her injuries—both past and future—as well as physical pain suffered now and anticipated later on along with lost earning capacity resulting from this incident.
