In a recent legal filing, Andrea Cerrato Plunkett has initiated a lawsuit against the United States Small Business Administration (SBA) in the Northern District of Texas. The case centers around a fraudulent Economic Injury Disaster Loan (EIDL) taken out in her name during 2020, which she claims was done without her knowledge or consent. Despite repeated attempts to alert the SBA and provide evidence of identity theft, Plunkett alleges that the agency failed to rectify the situation and unlawfully intercepted her tax refund through the Treasury Offset Program. The plaintiff is seeking declaratory and injunctive relief, as well as $50,000 in damages for negligence under the Federal Tort Claims Act.
