Aluche Holdings Accuses Greenwich Business Capital of Contractual Interference

Aluche Holdings Inc., an Oklahoma corporation, has taken legal action against Greenwich Business Capital, LLC and its principal member, John Ponte, accusing them of tortious interference with contractual relations and fraud. The complaint was filed on February 23, 2026, in the United States District Court for the Northern District of Texas. Aluche Holdings claims that Greenwich Business Capital’s actions have disrupted a settlement agreement between Aluche and a third party, Alan Sutton.

The dispute centers around a settlement agreement initially formed between Aluche Holdings Inc. and Alan Sutton of Playbrite Inc., wherein Sutton agreed to pay $70,000 to settle outstanding debts. This agreement followed a series of financial transactions involving Greenwich Business Capital (GBC), which had previously entered into agreements with Sutton. According to the complaint, GBC assigned its rights in these agreements to another entity but later initiated legal action against Sutton for the same account it had already assigned away. Aluche Holdings asserts that this move by GBC was intended to interfere with their settlement agreement with Sutton.

In detailing their case, Aluche Holdings outlines how they were nominated as an authorized servicing agent by BFG 104 LLC and Novapath Funding LLC—entities involved in subsequent financial transactions with GBC—and how they managed accounts including those related to Sutton’s debt. Despite reaching a resolution with Sutton through an agreed judgment, Aluche alleges that GBC’s actions have caused significant disruption and prevented Sutton from fulfilling his payment obligations due to ongoing litigation initiated by GBC under John Ponte’s direction.

The lawsuit further accuses GBC and Ponte of fraud, highlighting discrepancies in affidavits where GBC claimed not to have assigned any rights or interests despite evidence suggesting otherwise. Aluche contends that these false statements have resulted in financial harm as they are now forced to incur additional legal expenses while attempting to recover the amounts legally owed to them.

Aluche Holdings is seeking several forms of relief from the court: principal damages amounting to $70,000; treble damages due to alleged fraudulent activities; pre-judgment and post-judgment interest; costs associated with the suit; and any other equitable relief deemed appropriate by the court. They have also requested a jury trial for all issues at hand.
